Abstract

In the modern era, challenges related to attribution, proportionality, and jurisdiction have become increasingly complex, necessitating strategic measures. First, supply chain and cyber attacks complicate attribution, rendering the rules of engagement (ROE) irrelevant. Second, non-kinetic attacks, such as GNSS spoofing, create strategic impacts without legitimate options for kinetic response. Third, attacks on dual-use infrastructure exploit gaps between military and civilian jurisdictions. To address these threats, improvements in ROE are needed with a focus on effects. Each verified attack should be considered a Hostile Act, activating defensive responses. The establishment of an Intel-Legal Fusion Cell is also crucial for enhancing early warning systems and decision-making related to hybrid threats.
